Terms of Service
These terms are the agreement between you and Kuswanto covering AnyMarker — the desktop app, its licence keys, and this documentation. Buying a licence, starting the trial, or using the app means you accept them.
The short version
Pay once, use AnyMarker on your own machines for as long as you like, for personal or commercial work. Don't resell it or share your licence key publicly. It's a small tool made by one person — it comes as-is, and if something goes wrong the most you can get back is what you paid.
This summary is here for readability. The numbered sections below are the terms that actually apply.
Who you are dealing with
AnyMarker is made and licensed by Kuswanto, a sole trader based in Indonesia, operating through the website wanto.work. In these terms, “we”, “us” and “our” mean Kuswanto; “you” means the person or organisation using AnyMarker.
Payments are not handled by us. Polar Software Inc. acts as the Merchant of Record for every AnyMarker purchase. That means Polar is the seller on the transaction, takes the payment, charges and remits any sales tax or VAT, and issues receipts. Polar's own terms and privacy policy govern the payment itself; these terms govern the software.
Your licence
When your purchase completes, we grant you a non-exclusive, worldwide, perpetual licence to install and use AnyMarker. Perpetual means the version you bought does not stop working and does not need renewing — there is no subscription.
- Personal and commercial use are both allowed. Recording client work, monetised streams, or a company's internal videos with AnyMarker is fine. You do not need a different licence for commercial output.
- One licence covers one person and the machines that person uses — for example a desktop and a laptop. If several people at an organisation each use AnyMarker, each of them needs a licence.
- You are buying a licence, not the software. We keep all intellectual property rights in AnyMarker. AnyMarker is proprietary software; it is not open source.
What you may not do
You may not:
- Sell, rent, sublicense, or redistribute AnyMarker, or bundle it into a product you distribute.
- Publish, share, or resell your licence key, or post it anywhere it can be picked up by other people.
- Modify, decompile, or reverse-engineer AnyMarker in order to bypass its licensing, trial limits, or activation checks — or use, distribute, or promote anything built to do that. This does not restrict anything you are expressly permitted to do by law that cannot be contracted away.
- Remove or obscure copyright notices, the third-party notices file, or branding.
The bundled third-party components are a separate matter and are not restricted by this section — see Third-party software.
The free trial
AnyMarker offers a 7-day free trial with no card required. The trial is fully featured and is meant for exactly one purpose: finding out whether the app works for your setup before you pay.
- One trial per machine. This is a soft check meant to discourage casual resets, not a strict security measure.
- When the trial ends, AnyMarker shows a lock screen until a licence is activated. Nothing you created is deleted — your chapter
.txtfiles, presets, and settings stay on your disk, and any video you already embedded chapters into is unaffected. - We may change trial length or terms for future users, but never retroactively for a trial already running.
Buying, prices and tax
- AnyMarker is a one-time purchase of USD 14.99. There is no subscription and no recurring charge.
- Prices are shown in US dollars. Your bank or card issuer may convert the amount and may add its own currency-conversion fee, which we do not control and do not receive.
- Any VAT, GST, or sales tax is calculated, collected, and remitted by Polar as Merchant of Record, based on the billing country you enter at checkout. Your receipt from Polar is your tax document.
- We may change the price at any time. A price change never affects a licence you already bought.
- Refunds are covered by a separate Refund Policy, which forms part of these terms.
Licence keys and devices
After purchase, Polar issues you a licence key and gives you access to a customer portal where you can see it. Entering the key in AnyMarker activates that machine.
- Each licence allows a limited number of simultaneous activations. If you reach the limit, deactivate an old machine from AnyMarker's settings or from your Polar customer portal, then activate the new one.
- Activation records an opaque machine label so the same computer isn't counted twice. It is a one-way hash, not a hardware serial number — see the Privacy Policy for exactly what it contains.
- Deactivating a machine frees the activation slot. It does not reset a free trial that was already used on that machine.
- You are responsible for keeping your key private. If a key is being used by people who didn't buy it, we may deactivate or reissue it. If that happens to you and you didn't share the key, contact us and we'll sort it out.
Updates and support
- Updates within the version you bought are included. A licence for AnyMarker 1.x entitles you to every 1.x release, including bug fixes and new features, at no extra cost.
- AnyMarker checks for updates by requesting a small manifest file from our website. Updates are cryptographically signed and are verified before installation.
- If a future major version (2.x) is released as a paid upgrade, we will say so clearly. We are not obliged to release one.
- Support is provided by one person, on a best-effort basis, through the support form. There is no guaranteed response time and no service-level agreement.
Your recordings stay yours
AnyMarker runs entirely on your computer. It reads and writes your video files, chapter .txt files, presets, and settings locally. We never receive, upload, store, or process your recordings, your chapter titles, or your file names. There is no cloud component and no account to sign into.
You keep all rights in everything you record and everything AnyMarker writes for you. We claim nothing in it. See the Privacy Policy for the short list of things the app does send over the network.
Third-party software
AnyMarker bundles open-source components, each under its own licence: mp4v2 (mp4chaps, MPL-1.1), GPAC (MP4Box, LGPL-2.1-or-later), Node.js (MIT), and several MIT/ISC/Apache-2.0 libraries used in the interface. Those licences apply to those components regardless of anything in these terms, and nothing here limits the rights they grant you. AnyMarker works alongside OBS Studio but is not affiliated with, endorsed by, or sponsored by the OBS Project. OBS Studio is separate software with its own licence, and you need to install and configure it yourself.
No warranty
AnyMarker is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that AnyMarker will be uninterrupted, error-free, or compatible with every version of OBS Studio, every operating system, every codec, or every container.
Keep backups of anything you cannot afford to lose. AnyMarker edits video metadata in place rather than rewriting your files, and it backs up the region it touches before writing, but no software is immune to disk faults, power loss, or bugs. Treat a master recording the way you would treat any irreplaceable file.
Some countries do not allow the exclusion of implied warranties. Where that is the case, the exclusions above apply only to the extent permitted, and you keep any statutory rights that cannot be waived.
Limits on liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost recordings, or lost data, arising out of or connected to AnyMarker — even if we were told such damages were possible.
Our total liability for any claim relating to AnyMarker is limited to the amount you actually paid for your licence in the twelve months before the claim arose.
Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or anything else that cannot lawfully be excluded. If you are a consumer, these limits do not affect your statutory consumer rights.
Ending this agreement
- You can stop using AnyMarker and uninstall it at any time. Deleting the app does not delete your recordings, chapter files, or presets — those are ordinary files on your disk.
- We may terminate your licence if you materially breach these terms — for example by redistributing the app or publishing your key — and the breach is not fixed within a reasonable time after we tell you about it. Where the breach is deliberate and serious, we may terminate immediately.
- If your licence is terminated for breach, you must stop using AnyMarker and no refund is due. If a purchase is refunded, the licence ends when the refund is issued.
- The sections on intellectual property, warranty, liability, and governing law survive termination.
Changes to these terms
We may update these terms — for example if the product changes or the law does. The “last updated” date at the top always reflects the current version, and material changes will be noted on the product page. Changes apply from the date they are published and are not retroactive. If you don't accept a change, your remedy is to stop using AnyMarker; a licence you already bought continues to work under the terms in force when you bought it.
Governing law
These terms are governed by the laws of the Republic of Indonesia, and the courts of Indonesia have jurisdiction over any dispute, without regard to conflict-of-law rules.
If you are a consumer resident in the European Union, the United Kingdom, or another country whose consumer-protection law grants you mandatory rights, this clause does not deprive you of those rights or of the right to bring proceedings in the courts of the country where you live.
